Re: The Vietnamese Authorities' Blatant Violations of the Human Rights of Huynh Ngoc Tuan Family for: Violations of Freedom of Speech, of Privacy of Habitation; Assault and Battery; Defamation; and Illegal Confiscation of Private Property.

Dear Sirs:

On November 8, 2011, the authorities of Quang Nam Province, Vietnam, amassed a 200-strong uniformed and plainclothes police force to blockade and surround my residence at Unit 1, Phu Quy Hamlet, Tam Phu Village, Tam Ky District, Quang Nam Province (the residence belongs to my two sisters who provide lodging to me and my two children as I cannot afford housing after being imprisoned for 10 years and under house arrest for another 4 years). The police, in coordination with the Inspection Team of the Office of Information and Telecommunication of the Quang Nam Province, then raided the residence, searched, and seized a computer, a separate CPU, a Canon printer, a pair of computer speakers, an Internet router, under the pretext that my children and I used these pieces of equipment as means of "disseminating information against the Vietnamese Communist Party and the Vietnamese Government."

The authorities then directed online news channels to publish articles defaming me and my two children. Further, on November 22, 2011, the major news outlets controlled by the Socialist Republic of Vietnam simultaneously reported in advance that the government had imposed on me and my two children a fine of the sum of 260 million dong (Vietnamese currency, around 13,000 U.S. Dollars) for "administrative violations" of the information industry.

At 3 pm on December 2, 2011, approximately 100 policemen invaded our residence and blocked all points of entry and exit. They then proceeded to inflict bodily harm on my mother Pham Thi Yen, my daughter Huynh Thuc Vy, my son Huynh Trong Hieu, and my sisters Huynh Thi Huong and Huynh Thi Thu Hong. The policemen next read three citations against my family for, again, alleged administrative violations of information industry regulations, resulting in fines as follows: $100 million dong (around 4,800 U.S. Dollars)) against me, $85 million dong (around 4,100 U.S. Dollars) against my daughter Huynh Thuc Vy, and $85 million dong (around 4,100 U.S. Dolars) against my son Huynh Trong Hieu. The policemen went on to seize a Canon camera, six mobile phones belonging to my family, and my nephew Huynh Ngoc Le (who was sporting a T-shirt which bore a slogan against China's U-shaped maritime demarcation line in the South China Sea) for "interference with government officials in carrying out their duties" (my nephew was trying to shield my daughter against beatings by the policemen). After the police had left our premises, my sisters discovered that they had stolen 3,000 dollars in mixed currency of the U.S., Canada, and Australia from our cupboard.

In the citation of the alleged administrative violations, the authorities stressed that the fines be paid by the deadline of December 22, 2011. The authorities warned that if the fines were not paid by the due date, compulsory measures would be taken. Ever since, we have been distressingly worried as to what additional steps the government is contemplating against us.

All the actions taken so far by the Vietnamese communist authorities against my family have gravely violated the basic human rights stated in the Universal Declaration on Human Rights which the Vietnamese government formally signed in 1978. This declaration states:

Article 5: 
No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.

Article 9: 
No one shall be subjected to arbitrary arrest, detention or exile.

Article 12:
No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honor and reputation. Everyone has the right to the protection of the law against such interference or attacks.

Article 17:
(1) Everyone has the right to own property alone as well as in association with others.
(2) No one shall be arbitrarily deprived of his property.

Article 19:
Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers.

Article 28:
Everyone is entitled to a social and international order in which the rights and freedoms set forth in this Declaration can be fully realized.

The Vietnamese communist authorities have been carrying out the following activities with regularity and dangerous precedents:

- Smearing the honor and dignity, suppressing, harassing, and brutally terrorizing those who peacefully express their viewpoints, especially political ones.

- Illegally confiscating properties; assaulting; beating; and detaining innocent people.

The Vietnamese communist authorities have been using all possible brutal tricks to silence and exterminate opposing points of view all over Vietnam. Vietnamese have never enjoyed any basic freedom and human rights stated in the Declaration. Our dignity, integrity, human rights, and freedoms are being brutally trampled on by the Vietnamese communist authorities.

In the face of a dangerous and urgent situation of having our basic human rights---as stated in the Universal Declaration on Human Rights and the International Covenant on Civil and Political Rights--- blatantly violated, we earnestly beseech you, with your role and influence on international matters, to please ask the Vietnamese communist authorities to:

1. Respect the spirit of the Universal Declaration on Human Rights and the International Covenant on Civil and Political Rights.

2. Cease their brutal suppression of the freedom of expression by myself and my two children.

3. Release at once my innocent nephew, Huynh Ngoc Le.

4. Compensate for the damages, both mental and physical, suffered by all members of my family.

5. Reimburse, by way of equivalent cash money, all the items taken away from our house.

6. Cease all illegal brutal acts against all members of my family and all articles smearing our dignity and integrity published in government-controlled news outlets.

We urgently ask for your intervention for our basic human rights and our safety.

Ladies and Gentlemen,

On November 8 2011 , Quang Nam authorities have launched a powerful force of secret police, about 200 people blocking all the way around my house in Division 1 and Phu Quy village, Tam Phu, Tam Ky, Quang Nam (exactly my sisters house, because I have no home after 10 years in prison and four years probation, I and my children are living with my two sisters), together with union Inspectors of the Department of Information and Communications Quang Nam, breaking into my house, searched, sealed and seized a computer, a CPU tank left, a Canon printer, a USB, a set of computer speakers , a router used to connect to the network, for the reason: my father used three means to "spread the material on anti-Party and State."

The government also instructed his newspapers to defame honor of my father across their publications .On November 22, 2011, on the major state newspaper, Socialist Republic of Vietnam simultaneously reported on the sanctions my father 260 million VND (Vietnam dong) for administrative violations in the field of information technology.

At 3 pm Dec. 2, 2011, hundreds of police stormed into my house and bolted the entrance of the house, assaulted, beat my mother-Mai Thi Yen, my daughter , Huynh Thuc Vy, my son-Huynh Trong Hieu and my two sisters Huynh Thi Huong and Huynh Thi Thu Hong. They read three decisions on handling of administrative violations in the field of information technology, of which I was fined 100 million, my daughter-Huynh Thuc Vy 85 million, my son - Huynh Trong Hieu 85 million. A total of 270 million. Then they confiscated a camera ofCanon and 6 mobile phones and arrested my nephew , Huynh Ngoc Le (who was wearing No-U) on the truck to the police station as "anti- the duty "(as he broke into protection for Huynh Thuc Vy being beaten) after they withdrew from my home, my sister check the cabinets and found money missing of $ 3000, including the U.S. dollar, Australia, Canada).

In the decision of sanction administrative violations sent me, people asked us to pay a fine in the State Treasury until the deadline is December 22, 2011. If that is not paid overdue , we will be warned of coercive. My family is very confused what tricks they will take next.

All actions of the authorities of communist Vietnam has seriously violated the spirit of the Universal Declaration of Human Rights which they have solemnly signed in 1978. This Declaration has the following provision:

Article 5: No one shall be subjected to torture or punishment or cruelty, inhumanity, lower the dignity.

Article 9:
No one was arrested, imprisoned or exiled arbitrarily.

Article 12:
No one has right for arbitrary infringement of private life, family, home, or correspondence, as well as outraged honor or his reputation. Everyone has the right to legal protection against infringement of it.

Article 17:
Everyone has the right to own property as individuals .
No one shall be deprived of his property arbitrarily.

Article 19:
Everyone has the right to freedom of the concept and freedom of expression and opinion; the rights include the right without interference because of its conception, and the right to seek, receive and spread news and opinion by all media regardless of national borders.

Article 28:
Everyone is entitled to enjoy a social order and international order in which the freedoms specified in which this Declaration can be fully implemented.

The smear of honor, dignity and persecution, harassment, terror without mercy to those who exercise their right freely to express their views, particularly his political views; confiscation of illegal assets, assaulted, beaten, arrested, detained innocent citizen action are regular and dangerous precedent of the Communist regime in Vietnam. The government has defied all the brutal tactics to suppress opposition within the territory of Vietnam. The people of Vietnam do not enjoy the basic freedoms that have been declared and signed in the International Declaration of Human Rights. Conscience, dignity, human rights. our freedom is trampled an arbitrary way.

Before the Dangerous situation and the urgency of my family due to the violence, blatantly violated the spirit of the Universal Declaration of Human Rights and the International Convention on Civil and Political Rights, I would like to send anti- forward this letter to you for your crucial international role and competence of their diplomats particularly, please intervene to force the ruling Communist Vietnam government must:

1. Respecting the spirit of the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights.

2. End the raids on freedom of expression, freedom of the three us.

3. Free immediately my innocent nephew - Huynh Ngoc Le.

4. Compensation for damages for mental and material for the members of my family.

5. Refund of furniture, machines that police have captured from my family by paying cash, because we do not trust the integrity of the property they took from my house.

6. Completely eliminate all acts of harassment, beatings and dishonor my father on their media.

PETITION BY HUYNH NGOC TUAN AND HIS FAMILY

To bring to international public attention the brutal suppression of human rights – the right to freedom of speech, the right to security of home, body, honour, and property – by the Vietnam Communist Government

Kind attention:

• His Excellency Mr. Ban Ki-moon – The General Secretary of The United Nations;
• The European Commission;
• The Senate of The United States of America;
• The Government of The United States of America;
• The State Department of The United States of America;
• The Committee for Human Rights of The United Nations; and
• International Organizations That Are Concerned With Human Rights Issues

Sirs and Madams,

On November 8th, 2011, the authorities of Quang Nam Province sent a formidable force of police in uniform and civil clothes of about two hundred personnels to block all access to my house at Cluster 1 in the Village of Phu Quy, Tam Phu Commune, Tam Ky City, Quang Nam Province. (To be precise the house belongs to my sisters, since after ten years of imprisonment and four years of home detention I lost all my private housing, and therefore I and my children have been living in the house of my two sisters). The police force, supporting a team of inspectors from the Department of Information and Communication (DIC) of Quang Nam Province, broke into my house, inspected, sealed, and seized one desktop computer, one CPU unit, one Canon printer, one USB flash drive, one set of computer loudspeakers, and one Internet router for a charge that I and my daughter and son have been using these facilities to “circulate on the Internet anti-party and counter-state materials”.

The authorities also started a campaign to ruin my and my children’s reputation and dignity on their official websites. On November 22nd, 2011 major newspapers of the Socialist Republic of Vietnam concurrently broadcasted news of a fine of VND 260 million imposed on us for administrative violations in the field of informatics technology.

At 3.00 p.m. on December 2nd, 2011 hundreds of police broke into my house, blocked all exits, and violently flogged my mother, Mai Thi Yen, my daughter, Huynh Thuc Vy, my son Huynh Trong Hieu, and my two sisters, Huynh Thi Huong and Huynh Thi Thu Hong. They rehearsed three decisions on handling administrative violations in the field of informatics technology, by which I am fined VND 100 million, my daughter Huynh Thuc Vy, VND 85 million, and my son Huynh Trong Hieu, VND 85 million. The total fine is VND 270 million. To make things worse they robbed us of one Canon photo camera and six units of cell-phone, arrested my nephew Huynh Ngoc Le (who was wearing an anti-Chinese-invasion T-shirt), and transported him in a vehicle to a police station; they charged him with “opposing public servants on duty” (for his protecting Huynh Thuc Vy while the latter was being beaten up). After they went away my sisters examined their money cabinet and found that 3,000 of US dollars, Australian dollars and Canadian dollars were robbed.

The decisions on administrative violations, which were sent to me and my children, insisted that we are bound by the deadline of December 22nd, 2011 to make the payment at a State Treasury. After that deadline, as they warned, forced measures shall be taken. We are shattered after all these happenings and do not know what they are plotting against us in the coming days.

These acts of the communist government of Vietnam are seriously treading down on the spirit of The United Nations Universal Declaration of Human Rights of which they were a signing member in 1978 and by which it is dictated that: 

Article 5.
No one shall be subjected to torture or to cruel, inhuman or degradingtreatment or punishment.

Article 9.
No one shall be subjected to arbitrary arrest, detention or exile.

Article 12.
No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honor and reputation. Everyone has the right to the protection of the law
against such interference or attacks. 

Article 17.
(1) Everyone has the right to own property alone as well as in association with others.
(2) No one shall be arbitrarily deprived of his property. 

Article 19.
Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers.

Against innocent citizens who exercise their right to freedom of speech, particularly those expressing their political views, the Vietnam Communist Government have been applying a most revolting approach - ruining their honor and dignity, having them physically harassed and persecuted, terrifying them, illegally seizing their private properties, flogging and beating them up, having them imprisoned or arrested – all these are systematically and repeatedly practised. At any cost and by any vicious means the authorities have silenced opposition voices throughout Vietnam. The Vietnamese people are currently by no means enjoying the fundamental freedoms declared and committed by The Universal Declaration of Human Rights. Our Conscience, Dignity, Human Rights, and Freedom are constantly suppressed in a brutal way. 

Under this perilous and pressing circumstance when cruel and brutal treatment is infringed upon our family, and when the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights are neglected we appeal to you, with all your international roles and privileged diplomatic authority, to take intervening actions to the effects that the Vietnam Communist Government are obligated to:

1. Respect The Universal Declaration of Human Rights and The International Covenant on Civil and Political Rights 

2. Stop their brutal repression of our right to freedom of expression and freedom of speech;

3. Immediately release our guiltless nepphew Huynh Ngoc Le;

4. Make compensation for mental and material loss they inflicted upon members of our family;

5. Return, in cash, facilities taken from us, for once taken away the facilities became questionable for their integrity; and 6. Stop all physical harrassement and floggings inflicted upon us, and all blemishing acts to ruin our reputation on their media;

In earnest we plead for your appropriate and decent interventions.

Ngày 8 tháng 11 năm 2011 vừa qua, Chính quyền tỉnh Quảng Nam đã tung một lực lượng hùng hậu gồm công an chìm, nổi chừng 200 người án ngữ mọi nẻo đường chung quanh ngôi nhà tôi ở Đội 1, thôn Phú Quý, xã Tam Phú, Tam Kỳ, Quảng Nam (chính xác là nhà em gái tôi, vì tôi không có tư gia sau 10 năm tù và 4 năm quản chế, tôi và các con tôi đều sống với hai em gái tôi), phối hợp với đoàn Thanh tra của Sở Thông tin-Truyền thông Quảng Nam, đột nhập vào nhà tôi, khám xét, niêm phong và thu giữ 1 bộ máy tính, 1 thùng CPU rời, 1 máy in hiệu Canon, 1 USB, 1 bộ loa máy tính, 1 router dùng để kết nối mạng, với lý do: ba cha con tôi dùng những phương tiện này để “phát tán trên mạng những tài liệu chống đảng, Nhà nước”.

Nhà cầm quyền còn chỉ đạo cho các tờ báo của mình đưa thông tin bôi nhọ danh dự, nhân phẩm của ba cha con tôi trên khắp các trang mạng chính thống của họ. Ngày 22 tháng 11 năm 2011, trên các tờ báo lớn của Nhà nước Cộng hòa Xã hội Chủ nghĩa Việt Nam đồng loạt đưa tin về việc xử phạt ba cha con tôi 260 triệu đồng (tiền Việt Nam) vì đã vi phạm hành chính trong lĩnh vực công nghệ thông tin.

Vào lúc 3 giờ chiều ngày 2 tháng 12 năm 2011, cả trăm công an đã xông vào nhà tôi và chốt chặt các lối ra vào nhà, hành hung, đánh đập mẹ tôi- Mai Thị Yến, con gái tôi là Huỳnh Thục Vy, con trai tôi-Huỳnh Trọng Hiếu và hai cô em gái tôi là Huỳnh Thị Hường và Huỳnh Thị Thu Hồng. Họ đọc 3 quyết định xử lý vi phạm hành chính về lĩnh vực công nghệ thông tin, trong đó: phạt tôi 100 triệu đồng, con gái tôi- Huỳnh Thục Vy 85 triệu đồng, con trai tôi - Huỳnh Trọng Hiếu 85 triệu đồng. Tổng cộng 270 triệu đồng. Sau đó, họ tịch thu 1 máy ảnh Canon và 6 điện thoại di động của người nhà tôi và bắt luôn cháu trai tôi là Huỳnh Ngọc Lễ (lúc đó đang mặc áo No-U) lên xe chở về đồn công an vì “chống người thi hành công vụ” (do cháu xông vào bảo vệ Huỳnh Thục Vy đang bị đánh) Sau khi họ rút hết khỏi nhà tôi, hai em gái tôi đã kiểm tra lại tủ đựng tiền và phát hiện bị mất 3000 đô la, trong đó có cả đô la Mỹ, Úc, Canada).

Trong những quyết định xử phạt vi phạm hành chính được gởi cho ba cha con tôi, người ta yêu cầu chúng tôi phải nộp phạt tại kho bạc Nhà nước cho đến hạn chót là ngày 22 tháng 12 năm 2011. Nếu quá hạn đó mà không nộp phạt, người ta cảnh cáo là sẽ cưỡng chế. Gia đình tôi đang rất hoang mang không biết họ sẽ có thủ đoạn gì tiếp theo.

Tất cả những hành động trên của Nhà cầm quyền cộng sản Việt Nam đã xâm phạm nghiêm trọng tinh thần của bản Tuyên ngôn Quốc tế Nhân quyền mà họ đã long trọng ký kết năm 1978. Bản Tuyên ngôn này có những quy định như sau:

Ðiều 5: Không ai có thể bị tra tấn hay bị những hình phạt hoặc những đối xử tàn ác, vô nhân đạo, làm hạ thấp nhân phẩm.

Ðiều 9:
Không một ai bị bắt bớ, cầm tù hay lưu đày một cách độc đoán.

Ðiều 12:
Không một ai bị xâm phạm một cách độc đoán về đời sống riêng tư, gia đình, nhà ở, hay thư tín, cũng như bị xúc phạm danh dự hay tiếng tăm của mình. Mọi người đều có quyền được luật pháp bảo vệ, trước những xâm phạm ấy.

Ðiều 17:
Mọi người đều có quyền sở hữu tài sản cá nhân cũng như tập thể.
Không ai có thể bị tước đoạt tài sản của mình một cách độc đoán.

Ðiều 19:
Ai cũng có quyền tự do quan niệm và tự do phát biểu quan điểm; quyền này bao gồm quyền không bị ai can thiệp vì những quan niệm của mình, và quyền tìm kiếm, tiếp nhận cùng phổ biến tin tức và ý kiến bằng mọi phương tiện truyền thông không kể biên giới quốc gia.

Ðiều 28:
Ai cũng có quyền được hưởng một trật tự xã hội và trật tự quốc tế trong đó những quyền tự do ghi trong bản Tuyên Ngôn này có thể được thực hiện đầy đủ.

Việc bôi nhọ danh dự, phẩm giá và đàn áp, sách nhiễu, khủng bố không nương tay những người thực hiên quyền tự do bày tỏ quan điểm, đặc biệt là quan điểm chính trị của mình; tịch thu tài sản trái pháp luật, hành hung, đánh đập, bắt bớ, giam giữ công dân vô tội là những hành động thường xuyên và đã có nhiều tiền lệ nguy hiểm của Nhà cầm quyền cộng sản Việt Nam. Nhà cầm quyền đã bất chấp mọi thủ đoạn tàn độc để triệt hạ những tiếng nói đối lập trên toàn cõi Việt Nam. Người dân Việt Nam không hề được hưởng những quyền tự do căn bản đã được tuyên bố và ký kết trong Tuyền Ngôn quốc tế Nhân quyền. Lương tâm, Phẩm giá, Nhân quyền, Tự do của chúng tôi bị chà đạp một cách độc đoán.

Trước tình hình nguy hiểm và khẩn cấp của gia đình tôi với sự bạo tàn, ngang nhiên xâm phạm lên tinh thần của bản Tuyên Ngôn Quốc tế Nhân quyền và các Công ước quốc tế về Quyền Dân sự và Chính trị, tôi xin gởi kháng thư này đến quý vị mong với vai trò quốc tế quan trọng và thẩm quyền ngoại giao đặc biệt của mình, xin quý vị hãy can thiệp để buộc Nhà cầm quyền Cộng sản Việt Nam phải :

1. Tôn trọng tinh thần của Tuyên Ngôn quốc tế nhân quyền và các Công ước Quốc tế về quyền Dân sự và Chính trị.

2. Chấm dứt sự can thiệp thô bạo vào quyền tự do bày tỏ quan điểm, tự do ngôn luận của ba cha con tôi.

3. Trả tự do ngay lập tức cho cháu trai vô tội của tôi là Huỳnh Ngọc Lễ.

4. Bồi thường những thiệt hại về tinh thần cũng như vật chất cho các thành viên trong gia đình tôi.

5. Hoàn trả những đồ đạc, máy móc mà người ta đã thu giữ của gia đình tôi bằng cách trả tiền mặt, vì chúng tôi không tin tưởng vào sự nguyên vẹn của các tài sản mà họ đã lấy đi khỏi nhà tôi.

6. Chấm dứt hoàn toàn mọi hành vi hành hung,đánh đập và bôi nhọ danh dự ba cha con tôi trên các phương tiện truyền thông của họ.

Khẩn thiết thỉnh cầu sự can thiệp của quý vị và xin trân trọng kính chào.
